Licensing

While all images on this website are copyrighted by the photographer, Rich Ikerd, my licensing policies are designed to balance the desire to share my photos with the general public with the costs that go into creating and sharing these images. There are two license agreements for all photos on wahipanaphoto.com

Creative Common License

With the Creative Common license you are free to share, copy, distribute and transmit the image for non-commerical purposes under the following conditions:

• Attribution to Rich Ikerd and Wahi Pana Photography must be made along with the image
• The image must not be used for commerical purposes under any circumstances. For commerical use, please adhere to the Commercial License tenets.

Sample acceptable uses of the Creative Common License:

1. Blog post describing a trip and/or scene encountered
2. Online personal article that includes Wahi Pana Photography images
3. A school project that required photos that Wahi Pana Photography can supply
4. Using an image as a desktop background

Commerical Use License

Commerical Use regarding the use of Wahi Pana Photography images on-line or off-line is defined very broadly. The determination of commercial or non-commerical use is based on the contextual use of the image. The determination is NOT based on the tax-filing status of the individual or organization using the image nor on whether or not a financial transaction takes place. Commerical use of my images is only allowed if expressly granted by Rich Ikerd of Wahi Pana Photography. All commercial users will incur a licensing fee. These fees are based on the following criteria.

• Media - print, web, television, etc.
• Distribution Size - number of copies printed, viewing audience size, exposure (regional, national, etc.)
• Length of Use - 1 year, 2 years, etc.
• Promince of Display - 1/4 page, 1/2 page, spread, cover, billboard, etc.

Sample Use Requiring a Commercial Use License:

1. A marketing campaign for a commercial organization
2. A fund-raising campaign for a not-for-profit organization
3. A background image for any commercial or not-for-profit organization website
4. Creating an individual print for use in a private home or business
5. Use of an image in advertising of any kind
